1. Introduction:
These Terms and Conditions (“Terms”) govern all bookings and travel services arranged through Avontoer (Pty) Ltd. By making a booking or payment to Avontoer, the client acknowledges that they have read, understood, and accepted these Terms in full.
Avontoer acts as an agent between you and third-party service providers, including but not limited to airlines, accommodation providers, transport companies, and tour operators. All travel services are subject to the individual terms and conditions of those third-party suppliers.
2. Scope of Services:
Avontoer provides travel consultancy and booking services for domestic and international flights, accommodation, packages, cruises, transfers, tours, and related travel arrangements. We do not own or operate any of the travel services provided by third parties and therefore cannot be held liable for their performance or service delivery.
3. Booking Procedure and Payment:
3.1. Quotations issued by Avontoer are valid for a limited period as specified on the quotation and are subject to availability and supplier pricing at the time of confirmation.
3.2. Reservations on flights are only valid until 00:00 South-African time.
3.3. A non-refundable deposit (as indicated on the quotation or invoice) is required to secure a booking. No reservation will be confirmed until the required payment has been received.
3.4. Final payment must be made by the due date stated on the invoice. Failure to do so may result in automatic cancellation and forfeiture of any deposits paid.
3.5. All prices are quoted in South African Rand (ZAR) unless otherwise stated, and are subject to currency fluctuations, taxes, and supplier adjustments.
3.6. Payment may be made by EFT or card links provided. Card payments may incur processing fees.
4. Cancellations and Refunds:
4.1. All cancellation requests must be made in writing to Avontoer.
4.2. Cancellation fees will apply in accordance with the policies of the relevant third-
party supplier(s) and may include an additional administrative fee charged by Avontoer.
4.3. Certain airfares, hotel rates, or special promotions are non-refundable once booked.
4.4. Refunds, where applicable, will only be processed once received from the supplier. Avontoer cannot guarantee the timeframe for such refunds.
4.5. No refunds will be issued for unused portions of travel arrangements after departure.
5. Amendments and Changes:
5.1. Any change requested by the Client after confirmation (including date changes, corrections, or amendments) is subject to supplier approval and may incur additional costs.
5.2. Avontoer reserves the right to make necessary changes to itineraries or arrangements due to circumstances beyond its control, such as airline schedule changes, weather conditions, or government restrictions.
5.3. In such cases, Avontoer will make every reasonable effort to provide suitable alternatives of similar standard and value.
6. Travel Documents:
6.1. It is the Client’s sole responsibility to ensure that all travel documents, including passports, visas, health certificates, and vaccinations, comply with destination entry requirements.
6.2. Passports must be valid for at least six (6) months beyond the date of return travel.
6.3. Avontoer will not be held liable for denied boarding, refusal of entry, or additional costs resulting from non-compliance with travel documentation requirements.
7. Liability and Responsibility:
7.1. Avontoer acts only as an agent and does not control or operate any of the services provided by third-party suppliers.
7.2. Accordingly, Avontoer shall not be held liable for any loss, injury, damage, accident, delay, or irregularity arising from acts, omissions, or defaults of any third party.
7.3. Avontoer shall not be responsible for any additional expenses or losses incurred because of circumstances beyond its control, including but not limited to natural disasters, strikes, civil unrest, flight delays, or government actions.
7.4. The Client hereby indemnifies and holds Avontoer harmless from any claims arising from such occurrences.
8. Travel Insurance:
Comprehensive travel insurance is strongly recommended and remains the responsibility of the Client. Insurance should cover medical expenses, cancellations, curtailments, loss of personal belongings, and other travel-related risks. Avontoer can assist with arranging appropriate insurance upon request, but ultimate responsibility lies with the Client.
9. Privacy and Data Protection:
Avontoer respects the privacy of its clients. Personal information collected during the booking process will be used solely for travel arrangements and administrative purposes, in compliance with the Protection of Personal Information Act (POPIA). No personal data will be disclosed to third parties except where required to complete your travel booking.
10. Force Majeure:
Avontoer shall not be held liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from events beyond its reasonable control, including but not limited to acts of natural disasters, pandemics, terrorism, or governmental restrictions.
11. Governing Law and Jurisdiction:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the South African courts.
12. Acceptance of Terms:
By proceeding with a booking, payment, or any related transaction with Avontoer, the Client acknowledges that they have read, understood, and accepted these Terms and Conditions in full.
